Judge Howard Pemba of the Commercial Division of the High Court in Lilongwe on Tuesday declared that the land in Area 26, Kanengo, in the capital city, is the legitimate property of GM Properties.
According to Judge Pemba, there is sufficient evidence to prove that GM Properties lawfully acquired the land from the Ministry of Lands, and the villagers were informed about this acquisition.
However, the judge also directed that the villagers can be evicted, but only after they receive full compensation, with the valuations based on the current rate.
The ruling comes after GM Properties took the villagers to court for encroaching on their land, where they intend to construct uptown houses as part of the Kanengo Northgate Project.
The dispute began in May, 2021.
