Same sex marriages case adjourned to a later date

The High Court sitting as a Constitutional Court in Blanytre has on Tuesday adjourned the ‘Consential Same Sex’ case after parties involved wound-up their submissions.

Judge Joseph Chigona leading a panel of three judges in the case said the court will communicate the judgement day “in due course.”

The two-day session was meant for lawyers representing claimants, the respondents and Friends of the Court to submit their oral submissions.



In the case, claimants Wim Akster and Jana Gonani are being represented by Fostino Maere and Bob Chimkango respectively whilst lawyers Victor Jere and Thabo Chakaka-Nyirenda came as the state and Attorney General respectively.

Among others Friends of the Court in the case are Chikondi Chijozi, Pempho Likongwe, Innocentia Ottobar, Frank Mbeta and Bright Theu.

In the case, Wim Akster who is a dutch national and Jana Gonani (Malawian) are challenging the constituanality of laws that criminalize same sex relationships in Malawi.
